Trademark Protection & Intellectual Property Rights Notice

I. Introduction

This Trademark Protection and Intellectual Property Rights Notice ("Notice") constitutes a formal public declaration of the ownership, scope of protection, conditions of use, legal liabilities, and enforcement rights pertaining to the federally registered trademark "HACKMANIA" (Trade Mark No. 2893398) held by Hackmania® Technology Private Limited, a company incorporated under the Companies Act, 2013 and having its registered office at Plot No. 128, Defence Colony, Sainikpuri, Secunderabad, Telangana – 500094, India.

This Notice serves as both (i) a deterrent to unauthorized use and dilution of the Hackmania® brand and (ii) a record of our readiness to pursue all available civil and criminal remedies under applicable law.

Under Section 28(1) of the Trade Marks Act, 1999, Hackmania® Technology Private Limited enjoys exclusive rights to use the mark HACKMANIA® and to obtain statutory relief in the event of infringement. Section 29 expressly deems any identical or deceptively similar usage, capable of causing confusion or implying affiliation, as an infringement.

The following non-exhaustive list of confusingly similar or deceptively modified expressions is strictly prohibited unless prior written consent is obtained:

• Hackamania
• Hack-o-Mania
• Hackimania
• Hackathon Mania
• Hackersmania / HackerMania
• HackMyMania
• Hackxmania
• HackmaniaX
• Hackmania Club / Hackmania Events
• Hackmania India / Hackmania Global
• Any permutation visually, aurally, or conceptually similar to "Hackmania"

V. Misrepresentation, Passing Off & Dilution

Entities misappropriating the Hackmania® brand or derivatives may be liable for passing off (Section 27(2)), trademark dilution & false association, misrepresentation of origin (Consumer Protection Act, 2019), and unfair trade practice.

Upon first notice, the infringing party must within 7 calendar days remove the offending mark from all digital and offline assets, halt any suggestion of endorsement, and rectify third-party listings. Non-compliance triggers cease & desist proceedings, civil suits under Section 134, domain recovery (INDRP/UDRP), and public appropriation of the infringing event.
